Terms of Service

The short version

The rest of this document is the same thing in detail, and it is the part that binds.

1. Agreeing to These Terms

These Terms are an agreement between you and marge.ma (“we,” “us,” or “our”) covering your use of our four-way video chat service (“Service”). By creating an account, continuing as a guest, or using the Service in any other way, you accept them. If you do not accept them, do not use the Service.

2. Eligibility

You must be at least 18 years old. You confirm it when you create an account or continue as a guest, and by using the Service you represent that it is true. This is not a formality. The Service connects you to strangers on camera at random, and there is no version of it that is appropriate for a minor. If we find that an account belongs to somebody under 18 we will remove it without notice.

You must also not be barred from using the Service under the laws that apply to you, and you must not be evading a ban we have already issued.

3. What the Service Is

The Service places you in a room with up to three other people who did not choose you and whom you did not choose. Video and audio travel directly between participants wherever the network allows, and are relayed by our server when it does not. We do not screen who you will meet, we cannot promise that anybody will be online, and we do not guarantee that any connection will succeed.

A working camera is required. The Service checks that your camera is actually producing a picture and will remove you from the room if it is not. This is deliberate: watching without being seen is not what this is.

Everything you transmit stays yours. You give us only the permission we need to run the Service: to carry your video, audio, and messages to the other people in your room, and to store and review a still frame or a chat log where it has been flagged or reported, for as long as our Privacy Policy says we keep it. That permission is not exclusive, we do not charge you for it, and it does not extend to publishing your content, licensing it to anybody else, or using it to promote the site.

You confirm that you have the right to transmit what you transmit, and that doing so breaks no law and infringes nobody's rights.

7. Recording and Streaming

You may record or stream your own use of the Service. Plenty of people come here to do exactly that, and we would rather set out what is fair than pretend we can stop it.

The people who appear in your recording are a different matter. They did not choose their room and did not agree to an audience beyond it. So:

If you publish footage from the Service, it is your publication and your responsibility, not ours. That includes any claim brought by somebody who appears in it, which section 14 covers.

Everybody else should read this the other way round: assume you can be recorded here, because you can, and nothing we can build will change that. Our Privacy Policy says the same thing in plainer terms.

8. Automated Checks

Software running on our servers examines still frames from your camera and from any picture you upload, looking for nudity. It can suspend an account on its own, before any person has seen the frame. It is not perfect, in either direction. If it gets you wrong, appeal, and a person will look.

By using the Service you consent to these checks. They are not optional, and there is no way to use the Service without them.

The Service is free. We may introduce paid features or subscriptions later. Anything that costs money will say so clearly before you commit to it, and nothing you can do today will start charging you.

We may change, suspend, or discontinue any part of the Service at any time, including your access to it, and we may do so without notice. This is a small site run by a small number of people. It will sometimes be down.

12. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or free of error, and we do not warrant anything about the people you meet on it. You use it at your own risk.

Nothing in these Terms excludes any liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud.

13. Limitation of Liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, data, or goodwill, arising from your use of the Service or from anything another user does on it. Our total liability for any claim relating to these Terms or the Service will not exceed the greater of the amount you have paid us in the twelve months before the claim, or £50.

14. Indemnity

You agree to indemnify and hold harmless marge.ma and its operators against any claim, liability, damages, or costs arising from your use of the Service, your content, or your breach of these Terms.

15. Intellectual Property

The site's code, design, name, logo, and marks belong to us. You may not copy, reuse, or pass them off as your own without our written permission.

16. Copyright Complaints

If you believe something on the Service infringes your copyright, email amin@marge.ma with enough detail to identify the work and the material complained of, your contact details, and a statement that you believe in good faith that the use is not authorised. We will respond in accordance with the law and may remove the material and terminate repeat infringers.

17. Links and Other Users

Links and content shared by users are not ours and are not endorsed by us. Follow them at your own discretion. We are not responsible for what other users say, show, or do, on this site or off it.

18. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what we collect and how long we keep it.

19. Governing Law

These Terms are governed by the law of England and Wales. Any dispute arising from them or from the Service shall be resolved by arbitration seated in London under the Arbitration Act 1996, each party bearing its own costs unless the arbitrator orders otherwise. If you are a consumer, nothing here removes any right you have to bring proceedings in the courts of the country where you live, or any protection given to you by the law there that cannot be contracted out of.

20. General

If any part of these Terms is found unenforceable, the rest stays in force. Our not enforcing a term on one occasion does not waive it. You may not transfer your rights under these Terms; we may transfer ours if the Service changes hands.

21. Changes

We may update these Terms. The date at the top will change, and anything significant will be announced on our Discord. Continuing to use the Service after a change means you accept it.
